These Terms of Service ("Terms") govern your access to and use of Sonder.
By accessing or using the Service, you agree to these Terms. If you do not agree, you must not use the Service.
Account means your registered user profile.
Content means text, images, video, audio, data, or other material.
User Content means Content uploaded or shared by users.
Service means the Sonder platform and related websites, apps, features, integrations, and technologies.
You mean any person using the Service.
Tips means voluntary payments between users that do not create obligations or constitute payment for services.
Boosts means paid promotional features that increase visibility subject to platform rules.
Paid Content means digital content or features made available only after payment, subscription, tip, or other authorised monetisation action on the Service.
Restricted Adult Content means adult content that is only accessible to users who meet applicable age assurance or identity verification requirements and any other access controls set by Sonder.
Sonder is a digital platform that allows adult users to create profiles, share lawful content, and interact with others. Sonder is a technology hosting and promotional platform only.
We are not:
An employer, agent, or representative of users
a booking agent or intermediary for in-person services
a party to agreements or interactions between users
a financial institution or money transmission service or digital wallet provider.
Sonder does not permit, facilitate, advertise, arrange, or negotiate in-person sexual services, escorting, prostitution, or any unlawful offline activity.
Profiles are for self-representation and online interaction only. Sonder does not facilitate, arrange, promote, or monitor off-platform interactions between users. Any off-platform contact or services occur independently of Sonder and at users' own risk. Sonder may allow creators to monetise lawful digital content, including adult content that is subject to access restrictions, verification requirements, and platform rules.
We may modify, suspend, or discontinue features or any part of the Service where reasonably necessary for business, safety, technical, or legal reasons.
You may only use the Service if:
You are 18 years or older
you are legally permitted to access the Service in your location
you are not prohibited from using the Service under applicable Law.
We may require age or identity verification, including via third-party providers, to comply with the Online Safety Act 2021 (Cth) or other applicable laws. Certain features, including creator monetisation, payout access, or access to Restricted Adult Content, may require successful completion of additional identity or age verification processes.
Identity or age verification may be conducted through trusted third party verification providers such as Yoti. When verification is required, users may be asked to submit identity documents or biometric confirmation directly to the verification provider through a secure verification process. Sonder typically receives only a verification result or confirmation status and does not store identity documents or biometric data processed by third party verification providers unless required for legal, safety, or regulatory purposes.
You must create and maintain your own account. You must not sell, transfer, licence, rent, or share accounts or access credentials.
You are responsible for all activity that occurs through your account, whether authorised by you or not. We may assume that actions taken using your login credentials are yours. You must keep your account secure and notify us promptly if you believe it has been compromised.
If you use Sonder on behalf of a business, organisation, or public body, you confirm that you have authority to do so and that this agreement binds that entity.
We reserve the right to reclaim, modify, or reassign usernames, profile identifiers, or URLs where reasonably necessary, including where they are misleading, infringe intellectual property, impersonate others, or harm the integrity of the Service.
We may suspend or deactivate accounts that remain inactive for an extended period, subject to applicable law. Creators are responsible for ensuring that any identity, age, payout, tax, or verification information they provide is accurate, current, and complete.
Some features require payment, including promotional visibility boosts and voluntary tips. Sonder may also offer subscriptions, paid posts, paywalled content, or other monetisation features for lawful digital content. Some paid features may be unavailable or restricted for certain users or account categories where reasonably necessary for legal compliance, safety, or platform integrity.
Tips are voluntary gratuities sent by one user to another. Tips do not create any obligation between users and do not represent payment for services. Sonder does not control how recipients use funds. Tips must not be offered or requested in exchange for in-person services, meetings, or physical access.
Sonder does not provide stored value, digital wallets, escrow, or custodial services.
Paid boosts increase profile visibility but do not guarantee engagement, income, or outcomes. Boosts must not be used to advertise, imply, or facilitate in-person sexual services.
Sonder retains a 15% platform fee from applicable payments. This fee covers platform operation, risk management, and processing costs. Platform fees may change with reasonable notice. Third-party payment processing fees may apply in addition to the platform fee.
Payments are processed by third-party providers. Sonder does not hold funds on trust and is not responsible for delays, reversals, chargebacks, or errors caused by payment providers. Payments may be made using card payment methods, cryptocurrency, or other payment methods we make available from time to time. Where supported by our payment infrastructure, fiat payments may be converted into cryptocurrency as part of processing, settlement, creator balance administration, or payout workflows.
Creator payouts may be made in cryptocurrency only, subject to eligibility, verification, wallet requirements, third-party provider availability, and applicable law.
Payments are non-refundable except where required under the Australian Consumer Law (ACL). Access to Paid Content is conditional and may be revoked where reasonably necessary for fraud prevention, payment reversal, chargeback handling, legal compliance, or enforcement of these Terms.
Users are solely responsible for any taxes, duties, or reporting obligations associated with payments received or made. Creators are solely responsible for ensuring any wallet addresses, payout details, and related payment information are accurate. Sonder is not responsible for losses resulting from incorrect wallet details or unsupported cryptocurrency networks provided by a user.
You must comply with all applicable laws when using the Service.
Prohibited Content includes:
Any depiction of minors in sexual or nude contexts
child sexual exploitation material
non-consensual intimate imagery
AI or altered sexual content using a real person's likeness without consent
bestiality
extreme violence or terrorism
content that is unlawful in Australia
defamatory material about real persons
adult content uploaded by a creator who has not completed any verification required by Sonder for that type of content or monetisation feature
content that is offered, framed, or promoted as payment in exchange for in-person sexual services, meetings, or physical access
content involving any person whose age, identity, or consent cannot be reasonably verified if requested by Sonder.
Prohibited Conduct includes:
Harassment, threats, stalking, or doxxing
fraud, scams, or deceptive behaviour
impersonation or misrepresentation
circumventing age, safety, moderation, ranking, or visibility systems
uploading malware or harmful code
scraping, harvesting, or extracting platform data
creating or accessing accounts in an automated manner without written permission
using bots, scripts, crawlers, or similar tools
selling, buying, or transferring accounts, usernames, or access credentials
misusing reporting, dispute, or appeals processes, including making false or bad faith reports.
advertising, describing, arranging, or negotiating in-person sexual services, including by using coded or indirect language intended to bypass these Terms or the Community Guidelines
bypassing, attempting to bypass, or helping others bypass paywalls, access controls, age gates, verification systems, or monetisation restrictions
using Sonder's payment or monetisation features for money laundering, fraud, sanctions evasion, unlawful transactions, or any prohibited financial activity.
You retain ownership of your User Content.
You warrant that:
All persons depicted are 18+
all persons depicted consented to the creation and sharing of the content
you have the legal right to upload the content
the content complies with all applicable laws.
we may request proof of age or consent where reasonably necessary for safety or legal compliance.
If you upload or monetise adult content, including Paid Content or Restricted Adult Content, you must maintain records sufficient to demonstrate that every identifiable person appearing in the content:
Was at least 18 years old at the time the content was created
consented to the creation and distribution of the content
authorised its upload and distribution through the Service where applicable.
These records may include identification documents, performer releases, consent agreements, or other documentation reasonably capable of verifying age and consent.
Upon reasonable request, you must provide Sonder with evidence sufficient to verify the age and consent of individuals appearing in your content. Failure to provide such evidence within a reasonable timeframe may result in:
Content removal
monetisation restrictions
account suspension or termination
Sonder may retain copies of verification or consent evidence where reasonably necessary for safety, legal compliance, fraud prevention, or enforcement purposes.
You acknowledge that Sonder does not act as the producer, creator, or distributor of user-generated content and relies on the representations and warranties provided by users regarding age, consent, and rights to distribute content.
If you upload Paid Content or Restricted Adult Content, you also warrant that you have all rights, permissions, releases, and consents necessary to monetise, display, and distribute that content through the Service.
Licence to Sonder You grant Sonder a worldwide, non-exclusive, royalty-free, transferable, sublicensable licence to host, store, reproduce, display, moderate, distribute, and make technical modifications to User Content solely to operate, secure, improve, and promote the Service.
Moral Rights Consent To the extent permitted by law, you consent to acts or omissions by us that may otherwise infringe your moral rights in the Content.
Marketing Use We will only use your content for marketing or promotional purposes where you have provided express consent.
Content Removal and Persistence Content you delete may persist for a limited period in backups, logs, or technical systems, or remain visible where others have shared it, where reasonably necessary for legal, safety, or regulatory purposes.
We may remove, restrict, demonetise, disable access to, or require re-verification for content where we reasonably suspect issues relating to consent, legality, age verification, payment risk, fraud, or platform safety.
AI-generated images or media must be clearly labelled. You must not upload AI content that depicts a real identifiable person without their consent.
You must not use AI-generated content to impersonate another person or mislead users.
We respond to copyright complaints in accordance with the Copyright Act 1968 (Cth).
If you believe content infringes copyright, you may send a notice including:
Identification of the copyrighted work
identification of the infringing material
your contact details
a good faith statement
a statement of authority.
We may remove infringing material and may terminate accounts of repeat infringers.
This includes unauthorised reposting, copying, downloading, redistribution, resale, or off-platform publication of Paid Content or subscriber-only creator content.
We may remove or restrict Content or Accounts where reasonably necessary for:
Compliance with the Online Safety Act 2021
directions from the eSafety Commissioner
Law enforcement or regulatory requests
protection of users or the public
legal or operational risk management.
We may use automated systems and human moderators. We act as quickly as reasonably practicable once aware of unlawful material (eg 24-48 hours).
Users may report content or accounts through in-platform reporting tools or by contacting us directly. Reports of illegal or harmful content are prioritised.
Users may appeal moderation decisions where appropriate.
We may also restrict access to age-restricted or monetised features pending verification, payment review, fraud checks, consent review, or compliance assessment.
Our Privacy Policy explains how we handle personal information in accordance with the Privacy Act 1988 (Cth).
We may retain certain records where required for legal, safety, or regulatory purposes.
This may include identity verification status, payment and payout records, fraud prevention records, and moderation or consent-related records where reasonably necessary.
Identity documents or biometric data used for verification are typically processed directly by third party identity verification providers and are not stored by Sonder unless required for legal, safety, fraud prevention, or regulatory reasons.
All platform intellectual property belongs to Sonder or its licensors. You may not use our branding, trademarks, or proprietary materials without permission.
All rights not expressly granted to you are reserved by Sonder.
You must not reproduce, redistribute, resell, scrape, capture, publish, or exploit Paid Content obtained through the Service except as expressly permitted by the creator or by law.
We may suspend or terminate Accounts where reasonably necessary for:
Legal or regulatory compliance
safety concerns
fraud, abuse, or platform integrity risks
serious or repeated breaches of these Terms.
We will act proportionately where reasonably practicable.
We may also suspend monetisation access, payment access, payout access, or Restricted Adult Content access separately from the rest of an account where reasonably necessary.
The Service is provided "as is" and "as available." We do not guarantee uninterrupted, secure, or error-free operation.
We are not responsible for user behaviour, third-party services, external links, integrations, or off-platform interactions.
Sonder does not provide legal, medical, financial, or professional advice. Any information shared by users is for general purposes only and relied on at your own risk.
We do not guarantee that any content, creator account, payment method, cryptocurrency network, payout function, or monetisation feature will remain continuously available.
Nothing in these Terms excludes, restricts, or modifies rights you have under the Australian Consumer Law, including consumer guarantees.
Where services are not ordinarily acquired for personal, domestic, or household use, our liability for failure to comply with a consumer guarantee is limited (at our option) to:
Supplying the services again; or
paying the cost of having the services supplied again.
To the extent permitted by law:
We are not liable for indirect or consequential loss
we are not liable for disputes between users.
Our total liability relating to the Service is limited to the greater of:
USD $100; or
the amount you paid us in the previous six months.
This does not limit liability that cannot be excluded under law.
You acknowledge that interacting with other users and accessing user-generated content involves inherent risks, which you assume to the fullest extent permitted by law.
Without limiting the above, Sonder is not responsible for losses arising from payment processor decisions, blockchain congestion, wallet incompatibility, failed crypto transfers caused by incorrect user-supplied wallet information, chargebacks, access revocation following fraud review, or third-party verification system outages.
You agree to indemnify us for claims arising from:
Your content
your unlawful use of the Service
your breach of these Terms.
your failure to obtain required rights, releases, age verification, or consent for monetised or adult content
your misuse of payment, payout, cryptocurrency, or monetisation features.
This does not apply where loss is caused by our negligence or breach of non-excludable rights.
We are not liable for delays or failures beyond our reasonable control.
These Terms are governed by the laws of Victoria, Australia. Courts of Victoria have non-exclusive jurisdiction.
Nothing prevents Sonder from seeking injunctive or enforcement relief in other jurisdictions where reasonably necessary.
Before starting court proceedings, parties agree to attempt informal resolution. This does not affect statutory rights.
You may not assign or transfer your rights or obligations under these Terms without our consent.
We may assign or transfer this agreement in connection with a merger, sale, restructuring, or by operation of law.
If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force.
Our failure to enforce any right or provision does not constitute a waiver.
We may update these Terms where reasonably necessary.
If a change materially disadvantages you, we will provide notice and you may stop using the Service before the change takes effect.
Continued use after the effective date indicates acceptance.
