Intellectual Property Policy

We respect intellectual property rights and expect all users to do the same.

This policy explains:

What intellectual property violations are not permitted on Sonder

how copyright and trademark complaints can be submitted

how disputes may be raised

how Sonder enforces intellectual property rules in a proportionate and lawful manner.

This policy forms part of Sonder's Terms of Service and applies to all users. This policy is governed by the laws of Victoria, Australia and applicable Commonwealth laws. Nothing limits our obligation to comply with valid legal orders in Australia or other jurisdictions where legally required.

1. Scope & Platform Role

This policy applies to:

All content uploaded, shared, or displayed on Sonder

usernames, profiles, images, text, AI generated imagery, and links all areas of the platform

monetised digital content including subscription content, paid posts, tips, or other creator monetisation features.

Sonder is an online hosting and interaction platform. We do not broker, arrange, promote, or facilitate transactions or services between users, do not pre-screen all content, and are not responsible for user submitted material unless required by law.

We assess reports and take action where reasonably necessary to comply with law, reduce legal risk, or enforce our rules. Nothing in this policy creates a legal duty for Sonder to act on every report.

2. Copyright

Sonder responds to copyright complaints in accordance with:

Copyright Act 1968 (Cth)

applicable international copyright frameworks where relevant.

We act as a hosting service provider for user generated content and act expeditiously once notified of alleged infringement.

Copyright complaints may relate to:

Images, graphics, or written material

profile photos or banners

AI generated imagery that reproduces copyrighted works

links directing users to allegedly infringing content where Sonder materially hosts, controls, or displays that content

downloading and re-uploading creator content without permission

unauthorised reposting or redistribution of paid or subscriber-only creator content.

Some uses of copyrighted material may be lawful under Australian fair dealing exceptions (criticism, review, parody, satire, news reporting). Sonder does not provide legal advice.

3. Submitting a Copyright Complaint

If you are a copyright owner or authorised to act on behalf of one, you may submit a complaint.

Your notice must include:

Your full legal name and contact details

identification of the copyrighted work

the exact URL or clear location of the allegedly infringing material

a statement of good faith belief the use is not authorised

a statement that the information is accurate and you are authorised to act

your physical or electronic signature.

Incomplete notices may not be processed.Knowingly submitting false or misleading claims may result in account enforcement and legal consequences.

4. Review and Interim Measures

We review valid complaints in a reasonable timeframe (eg. 24-48 hours).

We may temporarily restrict content, accounts, or features while investigating.

If content is restricted or removed:

We notify the affected user where appropriate

we may share complaint details as required by law or fairness

we may provide information about how to dispute the action.

Deleting content does not automatically resolve a complaint.

5. Disputes About Removed Content

If you believe content was removed in error, you may submit a dispute including:

Your full legal name and contact details

identification of the removed material

an explanation of why removal was incorrect

a statement that your information is accurate

your electronic or physical signature.

Submitting a dispute means your contact details may be shared with the complainant where required by law.

We may restore content at our discretion unless legal risk remains.

Reposting removed content instead of using the dispute process may lead to account suspension.

6. Repeat Infringement & Abuse

We may suspend or terminate accounts that:

Repeatedly infringe intellectual property rights

repeatedly submit abusive or bad faith reports.

This may include repeated theft, redistribution, or resale of creator content that was originally uploaded by another user.

We consider valid disputes and retractions when assessing repeat behaviour.

7. Trademark Policy

Trademarks identify the source of goods or services. Misleading use of trademarks is not permitted.

This policy operates alongside:

Trade Marks Act 1995 (Cth)

Australian Consumer Law, including misleading or deceptive conduct provisions.

Violations may include:

Impersonating a brand or individual

suggesting false endorsement or affiliation

using brand names in usernames to mislead.

Not all trademark use is unlawful. Commentary, parody, criticism, and comparison may be lawful.

Only trademark owners or authorised agents may submit complaints.

8. Counterfeit & Infringing Goods

Sonder prohibits using the platform to promote or facilitate counterfeit goods or pirated digital content.

Prohibited conduct includes:

Advertising replicas or imitation branded goods

linking to pirated digital content

misrepresenting goods as genuine

selling or distributing pirated digital creator content obtained without permission.

Educational or commentary content about goods does not violate this rule.

9. Reporting Trademark or Counterfeit Issues

Reports must:

Be submitted by the rights holder or authorised agent

include sufficient and accurate detail.

Reporter information may be shared where required by law. Personal information is handled under our Privacy Policy.

10. Adult Content & Image Protection

Adult or nude content is subject to the same intellectual property protections as other content.

Users may only upload content they own or are authorised to share.

Being the subject of an image does not automatically grant copyright ownership.

Creators who monetise content on Sonder must ensure they hold the necessary rights, licences, and consent to distribute the content through the platform, including where content is shared behind subscription or paywall features. Creators may also be required under Sonder's Terms of Service to maintain records demonstrating the age and consent of individuals appearing in adult content and to provide such evidence if requested for safety or legal compliance purposes.

You must not upload:

Stolen creator content

leaked or non consensual intimate images

impersonation imagery

AI generated nude or sexualised imagery depicting a real person without consent.

content originally purchased or obtained from a creator and redistributed without permission.

We may immediately restrict access to content involving:

Non consensual intimate imagery

impersonation or likeness abuse

stolen creator material

commercial piracy.

Content involving child exploitation or illegal sexual material is removed immediately and may be reported to:

The eSafety Commissioner

The Australian Centre to Counter Child Exploitation

Law enforcement.

11. Online Safety & Legal Compliance

Sonder may remove or restrict content to comply with:

The Online Safety Act 2021 (Cth)

image based abuse laws

court orders or law enforcement requests.

We maintain records of enforcement actions where reasonably necessary for safety and legal compliance.

12. Transparency & Fair Process

Where appropriate and legally permitted, Sonder may publish transparency information about:

Volume of intellectual property complaints

repeat infringement actions

enforcement statistics.

We aim to apply enforcement proportionately and in good faith.

13. Important Warnings

Submitting complaints or disputes is a legal process. False or abusive submissions may result in:

Account suspension

loss of reporting privileges

rejection of future claims

potential legal consequences.

Seek legal advice if unsure of your rights.

14. Australian Legal Notes

Under Australian law:

Copyright usually belongs to the creator, not the subject

consent to appear does not equal ownership

image based abuse can be reported to the eSafety Commissioner

Rights holders may also seek remedies through Australian courts.

We may update this policy to reflect changes in law, regulation, technology, or platform operations. The latest version will be published on our website. Continued use of the Service indicates acceptance of updates.
